When the Case Ends, Your Responsibility Doesn’t: Understanding the Bail Bond Contract

When the Case Ends, Your Responsibility Doesn’t: Understanding the Bail Bond Contract

When you call eBail to help a loved one get out of jail, you’re not just doing a good deed—you’re entering into a legally binding contract. This agreement is between you (the cosigner) and us (the bail bond company), and it continues even after the defendant’s case is closed.

The Bail Bond Agreement: A Separate Contract from the Court

Many people believe that once the court case is over, their obligation to the bail bond company ends. That’s not the case.

The bail bond contract is completely separate from the court case. You’re not paying the court—you’re paying us for the service of getting your loved one released from jail. That service is based on the terms we discussed during your first call or visit to our office.

Real-World Example: The $10,000 Bail

Let’s say your friend’s bail is set at $10,000. In Nevada, the standard bail bond premium is 15%, so the total premium you owe is $1,500.

You come to eBail and pay $500 upfront, then set up a payment plan for the remaining $1,000.

Now let’s fast-forward:

  • Your friend shows up to all court dates
  • The case is closed
  • The bond is exonerated (officially released by the court)

Even though the case is over, you still owe the $1,000 balance. Why? Because you signed a contract to pay the full premium. That doesn’t disappear just because the court process ends.

When Does Your Obligation End?

Your financial responsibility to the bail bond only ends when:

  1. The bond is exonerated, AND
  2. Your premium is paid in full

Until then, the balance you owe is still due.

Missing Payments? Here’s What That Means

If you stop making payments or ignore your contract, it can lead to:

  • Collections
  • Negative credit reporting
  • Being denied if you ever need to cosign again in the future

We’re always willing to work with you—just talk to us. But don’t assume your responsibility ends with the case. It ends when your contract is fulfilled.
